Seven-Figure Jury Verdict While Defeating a $60 Million Counterclaim

Dorwart represented a Tulsa-based specialty contractor in a major construction dispute arising from the construction of a power plant in Maryland. The case involved complex contract claims, extensive technical evidence, and a $60 million counterclaim asserted by an international construction company.

The litigation threatened substantial financial exposure and years of additional proceedings. Success required not only proving our client’s claims, but defeating a counterclaim that dwarfed the amount our client sought to recover.

Rather than allowing the case to become consumed by technical disputes and competing project narratives, Dorwart focused the case on the contractual obligations that ultimately controlled the outcome. Through extensive discovery, expert preparation, and trial strategy, we narrowed the issues and concentrated attention on the facts that mattered most.

Following a two-week jury trial in Maryland state court, the jury returned a seven-figure verdict in favor of our client and rejected the opposing party’s $60 million counterclaim. The court also awarded litigation costs and prejudgment interest.

The result not only secured a substantial recovery for the client, but eliminated exposure that could have materially affected the company’s financial position.

Defense Verdict in $48 Million Minority Shareholder Action

Secured a defense verdict after a two-week federal jury trial for a publicly traded energy company in a minority shareholder action involving a cash-out merger. Plaintiffs sought $48 million. The jury awarded nothing, and the court awarded a seven-figure attorney fee recovery.

Defense Verdict and Attorney’s Fees Awarded in FINRA Arbitration

Successfully defended a regional broker-dealer in a FINRA arbitration involving approximately $20 million in fraud and suitability claims brought by a municipal government. Following a two-week hearing, all claims were denied and attorney fees were awarded.

Favorable Resolution of Putative ERISA Class Action

Defended one of Oklahoma’s largest financial institutions in a putative ERISA class action seeking alleged eight-figure damages. The matter was resolved with no admission of liability and only a nominal payment to the named plaintiffs.

Seven-Figure Judgment in Derivative Fiduciary Duty Action

Obtained a seven-figure judgment following a bench trial in a derivative shareholder action involving breaches of fiduciary duty.
